These Terms of Use ("Terms") form a binding agreement between you and Tujyane Ltd, a company registered under the laws of the Republic of Rwanda ("Tujyane," "we," "us," or "our"), and govern your access to and use of the Tujyane mobile app, the Tujyane website, the Tujyane Rentals dashboard, and all related services (together, the "Platform").
Tujyane operates a digital mobility platform in Rwanda that: (a) helps passengers find, book, share, and pay for rides and long-distance trips offered by drivers; (b) helps independent rental companies list vehicles and helps renters discover, book, and pay to rent those vehicles; (c) provides an in-app wallet for topping up, paying, transferring, and withdrawing funds connected to those activities; and (d) provides "Ecofleet," an informational public-transport tracking feature. Tujyane is a technology intermediary — it is not itself a transportation carrier, a taxi or bus operator, a vehicle rental company, a bank, or a licensed payment service provider, except where we say so expressly in writing.
1. Acceptance of These Terms
By creating an account, ticking the in-app agreement checkbox, accessing the app or website, or otherwise using any Tujyane service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not create an account or use the Platform.
If you use the Platform on behalf of a business or other organization (for example, registering a rental company), you confirm that you have authority to bind that organization to these Terms, and "you"/"your" in these Terms then refers to both you personally and that organization, jointly and severally where relevant.
2. Eligibility and User Roles
Tujyane currently supports the following user roles:
- Passengers, who request, book, and pay for rides or seats on shared/long-distance trips;
- Drivers, who offer rides, accept bookings, and drive passengers using their own or an authorized vehicle;
- Rental companies and their team members (an "Owner" who registers and administers the organization, and "Members" invited by an Owner), who list vehicles for rent and manage rental bookings through the Tujyane Rentals dashboard;
- Renters, who browse, book, and pay to rent vehicles listed by rental companies; and
- Staff, meaning authorized Tujyane personnel who administer, moderate, and support the Platform.
A single account may hold more than one role (for example, a driver may also rent vehicles as a renter). You must be at least 18 years old and have the legal capacity to enter into a binding contract to create an account or use the Platform in any role. Drivers, rental companies, and vehicle owners must also satisfy all onboarding, verification, licensing, insurance, vehicle, and other legal eligibility requirements we apply from time to time, including under Rwandan road transport and rental-vehicle regulations.
3. Your Account
- You must provide accurate, current, and complete information, including your legal name, phone number, and — where requested — email address, and keep that information up to date.
- Accounts are personal (or, for a rental company, organization-wide under an Owner's control) and non-transferable. You are responsible for all activity that occurs under your account.
- You must keep any credentials, verification codes (OTP), and connected sign-in methods (including Google or Apple sign-in) confidential, and must promptly notify us at info@tujyaneltd.com of any suspected unauthorized access.
- Where sign-up occurs through a one-time passcode sent by SMS, you are responsible for the security of the phone number used and must not share verification codes with anyone.
- We may suspend, restrict, or terminate accounts that are false, duplicate, impersonating another person, misleading, unsafe, or used in violation of these Terms.
4. Nature of the Service
Tujyane provides a technology platform for coordinating ride-sharing, long-distance trips, and vehicle rentals. Unless we expressly state otherwise in a separate written agreement, Tujyane does not itself provide transportation, does not own or operate the vehicles listed for rent, and does not guarantee that any ride, trip seat, or rental vehicle will be available, or that any driver or rental company will receive bookings.
Drivers and rental companies are independent of Tujyane and are solely responsible for the transportation or rental services they provide, including compliance with driving licenses, vehicle registration, insurance, roadworthiness, road safety, tax, and other regulatory obligations that apply to them under Rwandan law.
Ecofleet is an informational feature showing public transport routes and estimated arrival information. It is provided for convenience only; Tujyane does not operate the public transport vehicles shown and does not guarantee the accuracy of arrival estimates.
5. Driver Obligations
By using Tujyane as a driver, you agree that you will:
- hold and maintain a valid driving license, national ID or passport, vehicle registration, roadworthiness/technical inspection certificate, and insurance as required by Rwandan law, and upload true, current copies of these documents when requested;
- keep those documents up to date and promptly re-submit them before or upon expiry — bookings and payouts may be paused if a required document lapses;
- ensure your vehicle is roadworthy, safe, insured, and legally fit for the service you offer;
- not drive, or allow your vehicle to be driven through the Platform, under the influence of alcohol, drugs, or any substance that impairs safe driving;
- not allow an unauthorized or unverified person to use your driver account, accept bookings on your behalf, or drive passengers using your account;
- treat passengers respectfully, follow safe-driving practices, and comply with our safety, conduct, and trip policies; and
- keep your live location sharing enabled while a trip is in progress so that passengers and Tujyane can track the trip for safety purposes, as described in the Privacy Policy.
Tujyane staff review submitted documents and may approve, reject, request re-submission of, suspend, or remove driver access based on missing, expired, inconsistent, or non-compliant documents, or based on conduct or safety concerns. Document review decisions are made or checked by trained staff and are not based solely on automated processing.
6. Rental Companies and Vehicle Owners
If you register a rental company or list a vehicle for rent, you additionally agree that:
- the organization profile you submit (business name, address, logo, and contact/social details) is accurate and that you are authorized to register and act on behalf of that organization;
- every listed vehicle is legally owned or lawfully controlled by you, is registered, insured, and roadworthy, and that the vehicle registration, insurance, and inspection documents you upload are genuine, current, and accurately describe the vehicle;
- vehicle listings (photos, pricing, features, availability, and pickup/drop-off location) are accurate and kept up to date, and that at least the number of vehicle photos we require are true images of the actual vehicle;
- as an Owner of a rental organization, you are responsible for the actions of the Members you invite to manage that organization's fleet, bookings, and wallet on the Platform, and for promptly removing team members who should no longer have access;
- you will honor confirmed rental bookings, handle vehicle handover/return, damage, fuel, mileage, and deposit terms consistently with the rental terms you publish to renters and with applicable Rwandan consumer-protection law; and
- you remain responsible for your own tax, insurance, and regulatory obligations as a vehicle rental business — Tujyane's role is limited to providing the booking, payment, and communication platform.
Tujyane may review, approve, reject, suspend, or delist a rental company, a team member's access, or a vehicle listing where documents are missing, expired, or inconsistent, or where we reasonably believe a listing is inaccurate, unsafe, or fraudulent.
7. Passenger and Renter Obligations
By using Tujyane as a passenger or renter, you agree that you will:
- provide accurate pickup, drop-off, booking, and (for rentals) collection/return information;
- act lawfully and respectfully toward drivers, rental companies, and other users;
- not damage vehicles, tamper with safety equipment, or interfere with trip or rental safety;
- not use the Platform to harass, threaten, defraud, or impersonate any person;
- return a rented vehicle in the condition, at the time, and at the location agreed at booking, and bear the cost of loss, damage, fines, or unauthorized use that occurs during your rental period where you are responsible for it; and
- pay all valid fares, rental charges, fees, penalties, and other amounts associated with your bookings.
8. Bookings, Trips, Rentals, Cancellations, and No-Shows
Tujyane allows passengers to book seats or request rides (including shared, long-distance trips with per-seat booking) and allows drivers to accept, reject, cancel, or manage those bookings. Tujyane also allows renters to book vehicles listed by rental companies, and allows rental companies to accept, reject, or manage those bookings. Certain booking, cancellation, or no-show actions may trigger penalties, warnings, holds on wallet funds, suspensions, or other consequences under Tujyane's published trip and rental policies.
These policies may include, for example:
- passenger and renter cancellation penalties;
- driver and rental-company cancellation penalties;
- passenger and renter no-show consequences;
- driver no-show consequences; and
- rental-specific terms such as late-return fees, fuel/mileage charges, and damage assessment.
Published policies, in-app notices, and booking or rental screens form part of these Terms where applicable, and take precedence over this section for the specific matters they address.
9. Fares, Rental Charges, Wallet, and Payments
You agree to pay all charges shown through the Platform, including fares, rental charges, service fees, penalties, tolls, taxes, adjustments, and other disclosed amounts, in Rwandan Francs (RWF) unless stated otherwise.
- Tujyane provides an in-app wallet that lets you top up funds (via mobile money or bank transfer), pay for rides, trips, and rentals, send funds to another user, receive gifts, and — for drivers and rental companies — withdraw earnings to mobile money or a bank account. Wallet top-ups and payouts are processed through licensed mobile money operators (including MTN Mobile Money and Airtel Money) and partner banks, and may be subject to those providers' own terms, fees, and processing times.
- Passenger and renter charges may vary based on trip or rental details, distance, time, duration, route, demand, pricing rules, or applicable fees, and are disclosed to you before you confirm a booking.
- Driver and rental-company earnings, wallet balances, and withdrawals may be subject to platform commission, transaction fees, verification checks, payment-partner requirements, fraud review, and payout schedules, all of which we will disclose before you confirm a withdrawal.
- Refunds, credits, or reversals may be granted at our discretion, where required by law, or under an applicable policy.
- Tujyane does not itself hold a banking or deposit-taking license. Wallet balances represent funds held for your benefit to facilitate payments on the Platform and are not bank deposits or interest- bearing accounts.
10. Location Services
Certain features — including driver matching, live trip tracking, route and arrival-time estimates, geofenced pickup/drop-off notifications, and rental vehicle pickup/return locations — require access to your device's location, including background location while a trip you are part of is active. You can control location permissions through your device settings, but disabling location access may prevent these features from working. Details of how location data is collected, used, and retained are set out in our Privacy Policy.
11. Ratings, Reviews, Chat, and Safety Reports
Users may submit ratings, reviews, in-app chat messages, complaints, support messages, and safety reports. You agree that such content must be truthful and must not be unlawful, abusive, defamatory, or submitted in bad faith.
We may use ratings, reviews, chat content, and safety-related information to review account quality, resolve disputes, investigate incidents, and make platform safety decisions, as described in our Privacy Policy.
12. Prohibited Conduct
You may not use Tujyane to:
- break the law or assist unlawful conduct;
- discriminate against, harass, or threaten another user;
- submit false identity, driving license, vehicle, insurance, rental organization, or payment information;
- list a vehicle you do not own or are not lawfully authorized to rent out;
- scrape, reverse engineer, copy, interfere with, or disrupt the Platform or its underlying services;
- bypass security features, or create fraudulent accounts, bookings, wallet top-ups, or payouts;
- launder money or use the wallet, mobile money, or bank-transfer features for any purpose other than paying for or receiving payment for genuine rides, trips, or rentals booked through the Platform; or
- upload or transmit harmful code, malware, or content that infringes another person's rights.
13. Suspension, Termination, and Account Deletion
We may suspend, limit, or terminate your access immediately if we reasonably believe you violated these Terms, created a safety risk, failed verification, breached applicable law, submitted false information, or exposed Tujyane or other users to risk.
You may stop using the service, or request that your account be closed and your personal data deleted, at any time by contacting us at info@tujyaneltd.com. We will action such a request in line with our Privacy Policy, subject to information we are required or permitted to retain (for example, transaction, tax, and dispute records). Self-service account deletion within the app is planned but not yet available; until it is, deletion requests are handled by our support team.
Some obligations under these Terms survive termination or deletion of your account, including payment, dispute, liability, and indemnity provisions, and our right to retain records required by law.
14. Intellectual Property
The Tujyane app, branding, content, interface, and software are owned by Tujyane or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Platform for its intended purpose in line with these Terms.
By submitting reviews, ratings, chat messages, photos, or other content through the Platform, you grant Tujyane a non-exclusive, royalty-free license to use, store, reproduce, and display that content solely to operate, secure, and improve the Platform (for example, showing a review to other users or a vehicle photo to a prospective renter).
15. Privacy
Our collection, use, storage, and sharing of personal information — including identity documents, location data, payment and wallet information, and communications — are described in our Privacy Policy, which forms part of these Terms. By using Tujyane, you acknowledge that we may process personal information needed to operate the service, including account, trip, rental, location, payment, support, and safety-related data.
16. Third-Party Services
Tujyane relies on third-party providers for functions including mapping and route calculation (such as Google Maps and Mapbox), sign-in (Google and Apple), push notifications, mobile money and banking rails (such as MTN Mobile Money, Airtel Money, and partner banks), and crash/error monitoring. Your use of certain features may also be subject to those providers' own terms. We are not responsible for separate third-party products or services except as required by law.
17. Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Tujyane disclaims all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.
We do not guarantee uninterrupted access, exact route or location precision, successful payment processing, ride or rental availability, the roadworthiness or condition of any listed vehicle, or that any user will behave lawfully or safely. Tujyane is not a party to the rental agreement between a rental company and a renter, and does not guarantee the terms, condition, or performance of any rental.
18. Limitation of Liability
To the fullest extent permitted by law, Tujyane will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or business interruption arising from or related to your use of the Platform.
To the fullest extent permitted by law, Tujyane's total aggregate liability for claims arising out of or relating to the Platform or these Terms will be limited to an amount to be discussed and agreed between the parties, taking into account factors such as the nature and cause of the claim, the amount you paid to Tujyane through the Platform, and the circumstances giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Rwandan law.
19. Indemnity
You agree to defend, indemnify, and hold harmless Tujyane, its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, costs, and expenses arising out of your use of the Platform, your violation of these Terms, your breach of applicable law, or your infringement of another person's rights, including claims arising from a vehicle you listed or drove, or a trip or rental you booked.
20. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Rwanda, excluding conflict-of-law rules.
Before filing a formal claim, you agree to contact Tujyane at info@tujyaneltd.com and attempt in good faith to resolve the dispute informally within 30 days.
Unless applicable law requires otherwise, disputes arising out of or relating to these Terms or the Platform that cannot be resolved informally will be submitted to the exclusive jurisdiction of the competent courts of Kigali, Rwanda.
21. General
- Entire agreement. These Terms, the Privacy Policy, and any policy referenced in them are the entire agreement between you and Tujyane regarding the Platform, and supersede any prior agreement on the same subject.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- No waiver. Our failure to enforce a right or provision is not a waiver of that right or provision.
- Assignment. You may not assign or transfer your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Notices. We may provide notices to you by email, SMS, push notification, or in-app message, to the contact details on your account.
22. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email before the changes take effect and will update the "Last updated" date above. Continued use of Tujyane after changes take effect means you accept the updated Terms; if you do not agree, you must stop using the Platform.
